Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Withdrawal Period: the period during which the consumer may exercise their right of withdrawal.

Consumer: any natural person who purchases products for personal, non-commercial use through a distance contract with the Entrepreneur.

Day: calendar day.

Continuous Transaction: a distance contract relating to a series of products and/or services delivered or billed over time.

Durable Medium: any tool enabling storage of information for future reference without alteration.

Right of Withdrawal: the consumer’s right to cancel a distance contract within the withdrawal period.

Entrepreneur: BTB Commerce, operating under the trade name Sarah & Laura Toronto, offering products via distance selling.

Distance Contract: a contract concluded without physical presence through remote communication.

Distance Communication Technology: any means enabling a contract without simultaneous presence.

General Terms and Conditions: these terms as set out in this document.

Article 3 – Applicability

These Terms apply to all offers, orders, and agreements.

By placing an order, the consumer confirms acceptance of these Terms.

Statutory consumer rights remain unaffected.


Article 4 – The Offer

All offers are non-binding and subject to change.

Product descriptions and images are accurate but may vary slightly.

Each offer includes:

  • product price
  • shipping costs
  • delivery details
  • payment methods

Article 5 – The Agreement

The agreement is concluded upon order confirmation.

We reserve the right to refuse or cancel orders in case of:

  • suspected fraud
  • incorrect pricing
  • stock issues

Article 6 – Right of Withdrawal

Consumers may return products within 30 days.

Conditions:

  • unused
  • original condition
  • original packaging

Article 7 – Return Costs & Refunds

Return shipping costs are the responsibility of the customer.

Refunds are issued within 14 days after:

  • receiving the return, or
  • receiving proof of return shipment

We reserve the right to:

  • inspect returned items
  • refuse refunds if conditions are not met

Article 8 – Exclusions

Returns are not accepted for:

  • hygiene-sensitive items (e.g. earrings, underwear)
  • opened or used items
  • Final Sale products

Article 9 – Pricing

All prices are listed in CAD.

Prices exclude:

  • customs duties
  • import taxes

We reserve the right to correct pricing errors.


Article 10 – Warranty & Liability

We guarantee reasonable product quality.

We are not liable for:

  • indirect damages
  • misuse of products
  • delays caused by third parties

Article 11 – Delivery

  • Estimated delivery: 5–14 business days
  • Maximum delivery: 30 business days

Important:

  • Delays within this timeframe do not qualify for refunds or chargebacks
  • Orders are considered fulfilled once shipped and tracking is provided

If delivery exceeds 30 days:

  • customer may request refund

Article 12 – Payment

Payment is required at checkout.

Orders will not be processed without successful payment.


Article 13 – Customs & Import Duties

Orders may be shipped internationally.

Customer is responsible for:

  • customs duties
  • import taxes
  • handling fees

These costs are non-refundable.


Article 14 – Shipping & Returns Location

Orders are shipped from international fulfillment centers.

By placing an order, the customer agrees that:

  • products are shipped from overseas
  • returns must be sent internationally

Return instructions are provided via email.


Article 15 – Chargebacks & Fraud Protection 🔥

We actively monitor for fraudulent claims.

By placing an order, you agree that:

  • delivery confirmation (tracking) is valid proof of fulfillment
  • unauthorized chargebacks may be disputed with evidence

We reserve the right to:

  • block customers
  • take legal action in case of abuse

Article 17 – Applicable Law

These Terms are governed by applicable business law.

Consumer rights remain protected under local legislation.


Article 18 – Amendments

We reserve the right to modify these Terms at any time.


Article 19 – Disclaimer

We reserve the right to refuse returns or refunds if conditions are not met.

Nothing in these Terms limits statutory consumer rights.
